Yes, M&C will assist E-Verify participants with any questions about following E-Verify policies and procedures. The M&C self-assessment guides provide best practices for direct access users and Web services users using E-Verify. E-Verify participants may also call E-Verify Customer Support at 1-888-464-4218 from 8:00 am to 5:00 pm local time and ask to speak to a Monitoring and Compliance analyst who can assist you with any compliance questions you may have.
E-Verify will take appropriate administrative measures to assist participants to comply with E-Verify policies and procedures. M&C does not fine employers. However, in certain cases of suspected misuse, abuse, and/or fraud, M&C can recommend that an E-Verify participant be referred to agencies that investigate illegal employer activities
M&C may contact an E-Verify participant for a site visit if our records show a participant appears to be experiencing difficulties or issues when using E-Verify. Participants selected for a site visit receive a telephone call or email from M&C and are invited to participate in a site visit. We believe E-Verify participants benefit greatly from M&C’s comprehensive on-site assistance.
A site visit is a coordinated consultation between M&C staff and E-Verify participants conducted at the E-Verify participant’s place of business. During a site visit, two M&C staff members provide comprehensive compliance assistance. The M&C staff members discuss observations on how the E-Verify participant manages its account and processes E-Verify cases (i.e. case creation and closure). These observations allow M&C to provide the E-Verify participant with advice and direction on how to follow E-Verify policies and procedures
A desk review is a compliance assistance tool that consists of phone calls and emails between M&C and E-Verify participants. Desk reviews allow M&C to help E-Verify participants correct employment verification activities that M&C has detected as non-compliant. Participants selected for a desk review provide M&C with E-Verify employment-related documents, such as Tentative Nonconfirmation (TNC) notices, referral letters, and employment verification procedures and process documents. M&C reviews and analyzes these documents to determine if the participant is properly following E-Verify policies and procedures. M&C will then assist E-Verify participants to correct any problems and provide an enhanced level of customer assistance.
Yes, E-Verify’s Monitoring and Compliance (M&C) Branch monitors usage of E-Verify to detect, deter, and reduce misuse, abuse, and fraud. M&C monitors E-Verify participants and informs them when they are not in compliance with E-Verify policies and procedures.
