Sec. 212.10 Section 212(k) waiver. (Revised effective 11/28/11;

Any applicant for admission who is in possession of an immigrant visa, and who is
inadmissible under section 212(a)(5)(A) or 212(a)(7)(A)(i) of the Act, may apply at the port of entry for a waiver under section
212(k)
of the Act. If the application for waiver is denied, the application may be renewed in
removal proceedings before an immigration judge as provided in 8 CFR part 1240.
