OI 223a.2 Evidence.


The applicant's eligibility shall normally be determined on the basis of the documentary evidence submitted by the applicant and other pertinent data in the file. Any additional evidence or information which may be needed shall be requested. An alien who claims that he/she was considered a refugee under Article 1A(1)) of the U.N. Convention of July 28, 1951, shall be requested to submit evidence that he/she was so considered unless he/she is within OI 223a.3. An interview shall be conducted only when a m aterial question of fact cannot be resolved otherwise. A copy for the file shall be made of Form I-94 submitted by an applicant who is not a lawful permanent resident; upon return of the original Form I-94 to the applicant, it shall be marked on the reverse "I-571 issued" if the application is approved.
