OI 343 Interrogation/verification of applicant for naturalization.

OI 343.1 Interrogation.


If form N-580 presents a prima facie case, it shall be forwarded directly to the district director, without first interrogating the applicant, for issuance of the appropriate certificate. Interrogation of the applicant shall take place, however, before the application is so forwarded, if the applicant appears in person to file the application or if it appears necessary to interview him in order to properly adjudicate the application. In such a case the officer interviewing the applicant will complete the report on page 2 of Form N-580 before forwarding the application. In all other cases the interview shall take place at the time of the delivery of the certificate, and the examiner's report shall be completed at that time.


The interrogation of the applicant shall cover the matters upon which findings are made in the examiner's report on page 2 of Form N-580. If the original United States citizenship claimed falls within any of the classes described in section 341, the same degree of proof, including verification of entry, documents and witnesses to establish relationship to the person through whom citizenship is claimed, as is required in the proceedings under section 341, shall be required in the proceedings under section 3 41, shall be required of the applicant, unless the record clearly shows that such proof was submitted to a Service representative,m a naturalization court, or consular officer at the time of naturalization or repatriation. In either case a supplemental report showing the proof submitted to establish the original claim is based upon birth in the United States or naturalization, documentary proof of birth and proof or verification of the naturalization shall be required.


OI 343.2 Verification of naturalization.


The application shall not be granted without first obtaining verification of the applicant's naturalization from the Central Office on Form G-347.


OI 343.3 Issuance of certificate.


A certificate of repatriation shall be issued on Form N-581 for cases of repatriation under the Act of June 29, 1906. A certificate of naturalization shall be issued on Form N-570 for cases of naturalization under section 323 of the Nationality Act of 1940. Recitals in Form N-570 as to the basis for issuance shall be inserted in the following format in the space following in words "that (s)he": appeared before the United States District Court, Boston, Massachusetts, on January 112, 1974, and took the oath of renunciation and allegiance prescribed by the Nationality Act of 1940 and was thereby naturalized pursuant to section 323 of said Act, ad amended.


There shall be inserted as the certificate number in the upper right-hand corner thereof the court and petition number, thus "2270-P-17025."


Form N-582, heretofore used in section 323 cases, is hereby declared obsolete.
