Temporary (Nonimmigrant) Workers
|
In order for you to come the United States lawfully as a nonimmigrant to work temporarily in the United States your prospective employer must ordinarily submit a petition on your behalf to USCIS. Only a few of the classifications allow you to apply directly, without an employer. If you are outside of the United States you must apply for a visa upon approval of a petition. You may then use the visa to seek admission to the United States as a nonimmigrant. If you are already in the United States, you may be able to apply for a change to the correct nonimmigrant classification, or for an extension of a prior period of admission. If you are not in a valid nonimmigrant status or have not continuously maintained your status, your application for change of status or extension of stay may be denied, and you may need to go abroad to apply for a visa upon approval of the petition. For example, architecture, engineering, medicine, accounting. | H-1B1 | Free Trade Agreement professionals from Chile and Singapore. (See the “H-1B Specialty Occupations and Fashion Models” link to the left) | H-1B2 | Specialty occupations related to Department of Defense Cooperative Research and Development projects or Co-production projects. (See the “H-1B Specialty Occupations and Fashion Models” link to the left) | H-1B3 | Fashion model of distinguished merit and ability. (See the “H-1B Specialty Occupations and Fashion Models” link to the left) | H-IC | Registered nurse working in a health professional shortage area as determined by the U.S. Department of Labor. (This visa classification expired on June 13, 2005.) | H-2A | Temporary or seasonal agricultural worker | H-2B | Temporary or seasonal nonagricultural worker. For example, ski instructor, hotel employee, theme park worker, etc. (Returning H-2B workers are given the classification H-2R) | H-3 | Trainees other than medical or academic.
