DHS will implement the Inadmissibility on Public Charge Grounds final rule beginning on Feb. 24, 2020, including in Illinois. DHS published the rule on Aug. 14, 2019, but, shortly before the final rule was scheduled to go into effect on Oct. 15, 2019, several federal courts enjoined the rule (that is, legally prohibited DHS from implementing it at that time). The U.S. Supreme Court stayed the last remaining injunction on Feb. 21, 2020, and therefore DHS is no longer prevented from implementing the final rule.

On April 18, 2017, President Trump signed the Buy American and Hire American Executive Order, which seeks to create higher wages and employment rates for U.S. workers and to protect their economic interests by rigorously enforcing and administering our immigration laws. It also directs DHS, in coordination with other agencies, to advance policies to help ensure H-1B visas are awarded to the most-skilled or highest-paid beneficiaries.

USCIS will continue to process applications submitted under the pilot through Dec. 31, 2020, and will reject any applications submitted under the pilot starting Jan. 1, 2021. USCIS thanks all who were involved in the pilot.
