TPS SUDAN, NICARAGUA, HAITI, AND EL SALVADOR REMINDER: Certain EADs Remain Valid through Jan. 2, 2020

Employment authorization documents (EADs) with a category code of “A-12” or “C-19” and a Card Expires date as indicated in the chart below, remain valid through Jan. 2, 2020. 2017 2018 2019 07/22/2017 01/05/2018
TPS for Syria Extended for 18 Months; EADs Automatically Extended Through March 28, 2020

Acting Secretary of Homeland Security Kevin K. McAleenan announced that the Temporary Protected Status (TPS) designation for Syria has been extended for 18 months, through March 31, 2021. Current beneficiaries who want to maintain their status must re-register September 23, 2019 through November 22, 2019. Given the timeframes for processing TPS re-registration applications, USCIS has automatically extended the validity of certain Employment Authorization Documents (EADs) issued under the TPS designation of Syria through March 28, 2020.

Until further notice, employers should continue using the Form I-9 currently available on I-9 Central, even after the expiration date of Aug. 31, has passed. We will provide updated information about the new version of the Form I-9 as it becomes available.

Not All Nonimmigrants Are Eligible to Work

Some nonimmigrants are employment authorized incident to status in the U.S., which means they are eligible to work based on their nonimmigrant status or are eligible to apply for employment authorization. However, other nonimmigrants, such as temporary visitors for pleasure, are not eligible to work in the U.S.

Public Comment Period for Form I-9 Extension Open Until July 5, 2019

USCIS published a Federal Register notice to invite public comments on our proposed extension of Form I-9 before it expires on August 31. The Paperwork Reduction Act of 1995 requires a 60-day and a 30-day comment period for this Form I-9 extension. The second comment period will be open for 30 days, until July 5, 2019.
