1.2 USER RESPONSIBILITIES OVERVIEW

All Airport Operators and their users and agents are bound by the applicable requirements within the E-Verify MOU or E-Verify Terms of Service, the rules and responsibilities found in this Quick Reference Guide, the E-Verify User Manual (PDF), and other E-Verify program guidance, which is accessible from the Resources menu in E-Verify. All E-Verify users must successfully complete the online E-Verify tutorial before they can create and manage cases. Review the E-Verify User Manual for additional information on user roles.

RULES AND RESPONSIBILITIES OVERVIEW

Airport Operators participating in E-Verify and their users must:
  • Follow E-Verify procedures for each applicant to be confirmed with E-Verify.
  • Notify each applicant confirmed with E-Verify of E-Verify participation by displaying current postings supplied by DHS in a prominent place that is clearly visible to all individuals who are to be verified.
  • Collect and retain the document type, document number and document expiration date for the documents presented by each applicant confirmed with E-Verify before creating a case in E-Verify.
  • Obtain a Social Security number (SSN) from each applicant confirmed with E-Verify.
  • Ensure that any Form I-9, Employment Eligibility Verification, List B identity document used for confirmation with E-Verify has a photo.
  • Provide each applicant who receives an E-Verify Tentative Nonconfirmation (TNC) the opportunity to contest the TNC.
  • Ensure that all applicant personally identifiable information is safeguarded.
Airport operators participating in E-Verify and their users must not:
  • Use E-Verify to discriminate against any applicant on the basis of his or her national origin, citizenship or immigration status.
  • Selectively confirm the employment eligibility of any applicant with E-Verify, i.e. use E-Verify for some applicants but not others.
  • Share any user ID and/or password.
