Update to Legislation Related to Ukrainian Humanitarian Parolees

A recent legislative extension in the Ukraine Security Supplemental Appropriations Act, 2024 (USSAA) provides that Ukrainian citizens and nationals, as well as certain non-Ukrainians who last habitually resided in Ukraine, who were paroled into the United States between Feb. 24, 2022 and Sept. 30, 2024 “shall be eligible for resettlement assistance, entitlement programs, and other benefits available to refugees admitted under section 207 of the Immigration and Nationality Act (INA) (8 U.S.C. § 1157) to the same extent as such refugees” unless parole has been terminated by the Secretary of Homeland Security. Previously, eligibility was limited to individuals who were paroled between Feb. 24, 2022, and Sept. 30, 2023, under the Additional Ukraine Supplemental Appropriations Act, 2022 (AUSAA).
Citizens of the Freely Associated States Eligible for PRWORA Benefits

The Compact of Free Association Amendments Act of 2024 (CFAA) expanded the Personal Responsibility and Work Opportunity Act of 1996 (PRWORA) definition of “qualified aliens” to include citizens of the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau. These nations are collectively known as the Freely Associated States (FAS).
Somalia Redesignated for TPS and TPS Extended for 18 Months; Certain EADs Automatically Extended Through Sept. 17, 2025

Secretary of Homeland Security Alejandro Mayorkas extended and redesignated Somalia for Temporary Protected Status (TPS) for 18 months, from Sept. 18, 2024, through March 17, 2026. Given the time frames for processing TPS re-registration applications, USCIS has automatically extended through Sept. 17, 2025, the validity of Employment Authorization Documents (EADs) with a Card Expires date of Sept. 17, 2024, or March 17, 2023, issued under the TPS designation for Somalia.
TPS for Yemen Extended and Redesignated for 18 Months; Certain EADs Automatically Extended Through Sept. 3, 2025

Secretary of Homeland Security Alejandro Mayorkas extended and redesignated Yemen for Temporary Protected Status (TPS) for 18 months, from Sept. 4, 2024, through March 3, 2026. Given the time frames for processing TPS re-registration applications, USCIS has automatically extended through Sept. 3, 2025, the validity of Employment Authorization Documents (EADs) with a Card Expires date of Sept. 3, 2024, or March 3, 2023, issued under the prior TPS designation of Yemen.

President Biden issued a Memorandum on Extending Eligibility for Deferred Enforced Departure for Liberians to the secretaries of state and homeland security that defers through June 30, 2026, the removal of any Liberian national, or person without nationality who last habitually resided in Liberia, who is present in the United States and who was under Deferred Enforced Departure (DED) as of June 30, 2024.In addition, President Biden continued through June 30, 2026, employment authorization for individuals included in these categories.We will publish a Federal Register notice as soon as possible to implement the president’s memorandum.
Temporary Protected Status (TPS) for Haiti Extended and Redesignated for 18 Months; Certain Employment Authorization Documents (EADs) Automatically Extended Through Aug. 3, 2025

Secretary of Homeland Security Alejandro Mayorkas extended and redesignated Haiti for TPS for 18 months, from Aug. 4, 2024, through Feb. 3, 2026. Given the time frames for processing TPS re-registration applications, USCIS has automatically extended through Aug. 3, 2025, the validity of EADs issued under the prior TPS designation of Haiti with a Card Expires date of: • Aug. 3, 2024; • June 30, 2024; • Feb. 3, 2023; • Dec. 31, 2022; • Oct. 4, 2021; • Jan. 4, 2021; • Jan. 2, 2020; • July 22, 2019; • Jan. 22, 2018; or • July 22, 2017.

USCIS Issues Notices Extending Certain TPS EADs Through March 9, 2025

USCIS is issuing Form I-797, Notice of Action, to certain Temporary Protected Status (TPS) beneficiaries who are eligible to re-register for TPS or have a pending application to renew their Form I-766, Employment Authorization Document (EAD). This notice further extends the validity of their EAD through March 9, 2025.
