Public Comment Period for Professional Conduct Rule Reopened and Extended

The Department of Homeland Security (DHS) published a notice in the Federal Register announcing the reopening and extension of the public comment period for the interim rule, "Professional Conduct for Practitioners: Rules, Procedures, Representations, and Appearances." The interim rule was published on Feb. 2, 2010, at 75 FR 5225. The comment period ended on March 4, 2010.
In response to requests to allow additional public comment, DHS is reopening the comment period for an additional 30 days, from Jan. 31 to March 2, 2011. The interim rule was effective on March 4, 2010, and the changes made in the rule are and will remain in force and effect notwithstanding this notice. DHS will consider comments received during the entire public comment period while developing the final rule. The interim rule:
- Clarifies who is authorized to represent applicants and petitioners in cases before DHS;
- Updates and enhances the standards and disciplinary procedures for these immigration practitioners;
- Eliminates duplicative immigration adjudication rules, procedures and authority;
- Conforms the grounds of discipline and procedures with regulations of the Department of Justice (DOJ); and
- Makes technical and procedural changes; and conformed DHS and DOJ terminology.
