If you or a relative of yours has a refugee application that was denied in Vienna, Austria, it may be affected by the settlement in Doe v. Mayorkas. You can use the case check tool below to check whether you or your relative’s case is covered by the settlement agreement.

The WRAPS Case Number can be found at the top of the case notice indicating that USCIS denied you or your relatives prior refugee application. You may have received correspondence with a longer case number (e.g. IR-00123456). If so, omit the first two zeros (“00”) when searching below.

Background

In early 2018, US Citizenship and Immigration Services (USCIS) denied the refugee applications of 87 individuals from Iran who were staying in Vienna, Austria and who had applied for resettlement in the United States through a special program for certain religious minorities.  On April 18, 2018, a complaint was filed in the United States District Court for the Northern District of California, Doe v. Nielsen (now Doe v. Mayorkas), 18-cv-2349 challenging the denials.  Under the terms of the final settlement agreement, preliminarily approved on December 9, 2021, USCIS has agreed to reopen each of the denied cases for reconsideration.  The Refugee Settlement Center Austria (RSC Austria), on behalf of the Department of State and USCIS, has attempted to contact the affected individuals to alert them to this settlement via mail and email.

AUTHORITIES: The information requested by the WRAPS Case Lookup, is collected under the Immigration and Nationality Act section 207.

PURPOSE: The primary purpose for collecting your DOS WRAPS case number is to assist you with determining whether you may be included in the Doe v. Mayorkas settlement.

DISCLOSURE: The information you provide is voluntary. However, failure to provide the requested information, may prevent USCIS from providing you with a response to determine whether you may be included in the Doe v. Mayorkas settlement.

ROUTINE USES: Information disclosed to DHS by DOS may be used by and disclosed to DHS personnel and contractors or other agents who need the information to assist in activities related to your inquiry. The information may be shared in accordance with approved routine uses described in the associated published system of records notice [STATE-59-Refugee Case Records (PDF)] and as described in the Privacy Impact Assessments [DHS/USCIS/PIA-064 myUSCIS and DOS Refugee Processing Center - General Support System].
